HOAs are governed by their Memorandum of Incorporation (MOI), the Companies Act (we are registered as a NPO), Conduct Rules, and relevant property laws.
An elected Board of Directors oversees the operations together with the estate manager and support staff.
Homeowners must comply with the HOA’s governing documents, pay levies, and maintain their properties, among other duties.
Levies and Finances
Levies are mandatory contributions from homeowners to cover communal expenses, such as security, maintenance, and landscaping.
Levies are typically calculated based on the HOA’s budget, divided among homeowners proportionally or as specified in the MOI.
Non-payment may lead to penalties, interest charges, and legal action, including blacklisting or property attachment.

Rules and Regulations
The rules are usually included in the MOI or issued separately. Request a copy from the HOA Office.
The HOA can enforce rules that affect the community’s aesthetics or shared interests, as specified in the governing documents.
Disputes may be resolved through internal dispute resolution processes or referred to the Community Schemes Ombud Service (CSOS) after the internal remedies have been exhausted.
Maintenance and Shared Spaces
The HOA maintains communal areas, such as roads, parks, and security systems. The homeowner is responsible for their property.

Meetings and Voting
The AGM schedule is outlined in the MOI, held annually within six months after the financial year-end.
Voting can occur during meetings or by proxy, as specified in the HOA’s rules.
Yes, any homeowner in good standing (e.g., with no overdue levies) who is allowed to stand as a director in terms of the Companies Act, is eligible to run for a position.
Security and Access
All residents must be registered on the biometrics system to gain access to the estate. The security is on duty 24 hours a day and all security-related matters can be reported to the HOA Office.
The HOA allows visitor access through prior authorization or specific procedures.
Property Modifications
Structural or aesthetic changes require prior HOA approval to ensure compliance with community guidelines.
You may face penalties and be required to restore the property to its original state.
Selling and Renting
Notify the HOA, obtain clearance certificates, and ensure compliance with the HOA’s transfer requirements.
Yes, but you must inform the HOA and ensure the tenant complies with the rules. The HOA Office should also have a copy of the lease agreement.
